General terms and conditions of Blinktank GmbH.
RECOMMENDED PROVIDERS
This page explains the general terms and conditions for placements on amtsguide.de.
1. Scope and contracting parties
1.1 Provider
These terms apply to all contracts for services of Blinktank GmbH.

1.2 Customer
A customer under these terms is any company that books a paid placement on amtsguide.de. That includes a service provider or a trade business.
1.3 Application
These terms apply exclusively and other customer terms apply only after our express written agreement.
2. Description of services
2.1 Platform
AmtsGuide operates the online platform amtsguide.de. End users find structured information, calculators and digital assistance for administrative processes in Germany. AmtsGuide lists service providers as customers with contact and topic metadata in a provider directory.
2.2 District-based placements
Customers book paid placements in one or more districts in these levels.
- Basic placement: listing as a paid provider with the standard presentation
- Premium placement: highlighted presentation with additional contact and topic fields
- Featured placement: top placement with maximum visibility and all available contact fields
2.3 Scope of service
A placement includes these services.
- Listing on the relevant district page, for example /de/berlin/halteverbot/mitte/
- Presentation of the company name, contact details, topic relationship and placement context
- A clickable link to the company website with click measurement
- Access to the customer portal with click statistics
- A monthly performance report by email
2.4 Capacity limit
A maximum of four paid placements is available per district and topic as Sponsor and Featured. Bookings follow availability and receipt of payment in the order of payment.
3. Formation of the contract
3.1 Offer and acceptance
You make a binding offer for a placement contract. You do this through the booking form or through a written order.
We may accept the offer within 7 days. Acceptance is a written order confirmation or activation of the placement. An order confirmation by email counts as written.
3.2 Contract term
Placement contracts have one of these terms.
- Monthly: a term of 1 month, automatically renewed for further periods of 1 month
- Annual: a term of 12 months, automatically renewed for further periods of 12 months
Without termination the contract renews automatically for the same term. Monthly contracts need 4 weeks notice to the end of the month. Annual contracts need 3 months notice to the end of the term.
4. Prices and payment
4.1 Prices
The prices on the website or in the order confirmation at the time of booking apply. All prices are net prices plus statutory VAT.
Current packages, examples:
- Basic: €29 per month and district
- Premium: €79 per month and district
- Featured: €149 per month and district
We may adjust prices with notice of at least 4 weeks.
4.2 Payment terms
Invoices are due within 14 days of the invoice date without deduction.
Payment methods:
- SEPA direct debit, preferred for subscriptions
- Bank transfer
- Credit card through a payment provider
SEPA direct debits are collected at the beginning of each month.
4.3 Late payment
If payment is late, we may take these steps.
- Charge default interest at 9 percentage points above the base rate
- Pause or remove the placement
- Suspend access to the customer portal
- Terminate the contract for cause
5. Customer obligations
5.1 Duty to provide information
You provide truthful and complete information and report changes to contact details without delay. You provide a valid email address for invoicing.
5.2 Legality
You warrant these points.
- You are entitled to provide the advertised services
- All required permits and licences are in place
- The services are provided in compliance with the law
5.3 Trade marks and supplied content
You supply trade mark information or other company data. You warrant that you are entitled to use the material. You do not infringe third-party rights.
6. Our obligations and services
6.1 Availability
We aim for annual average platform availability of 99 percent. Announced maintenance and force majeure are excluded.
6.2 No promise of success
We do not guarantee a particular number of clicks, enquiries or contracts. A placement provides visibility only and does not guarantee commercial success.
6.3 Click statistics
We provide these statistics through the customer portal.
- Number of clicks per month
- Distribution by district
- Development over 30 days
- Top pages
We prepare the statistics to the best of our knowledge without a guarantee of absolute accuracy.
7. Termination
7.1 Ordinary termination
You and we may terminate the contract in text form. Email is sufficient.
- Monthly contracts: with 4 weeks notice to the end of the month
- Annual contracts: with 3 months notice to the end of the contract term
7.2 Termination for cause
The right to terminate for good cause remains in place.
Good cause includes these cases in particular.
For us:
- Payment more than 14 days overdue
- A breach of these terms
- An infringement of rights by the customer
- Customer insolvency
For you:
- Platform unavailability for more than 7 consecutive days
- A serious breach of contract by us
7.3 Grace period
After late payment or the end of a contract the placement stays visible for 72 hours. This time is the grace period.
8. Right of withdrawal for consumers
These terms are primarily intended for businesses. If a consumer books a placement, the statutory right of withdrawal of 14 days applies.
Withdrawal information
You have the right to withdraw from this contract within 14 days without giving a reason.
The withdrawal period is 14 days from the date of the contract.
To withdraw, you inform us with an unequivocal statement. Email is sufficient. Our address is Blinktank GmbH, Hauptstr. 5L, 10317 Berlin.
Consequences of withdrawal
After a withdrawal we repay all payments received from you. The repayment is without delay and no later than 14 days.
You may expressly request that the service begin immediately. Your right of withdrawal then ends when the contract is fully performed.
9. Liability
9.1 Limitation of liability
We have unlimited liability for intent and gross negligence. We have unlimited liability for injury to life, limb or health.
For ordinary negligence we are liable only for a breach of essential contractual obligations. In that case liability is limited to the foreseeable loss typical for this type of contract. The relevant time is the conclusion of the contract.
9.2 Data loss
Liability for data loss is limited to the typical restoration cost. This cost arises with regular backups that match the risk.
9.3 Force majeure
We are not liable for an inability to perform or for delays caused by force majeure. That also applies to other events that are not foreseeable at the time of the contract.
10. Data protection
Personal data is processed in accordance with our privacy policy.
The GDPR applies to the processing of customer data such as billing addresses and contact persons.
11. Intellectual property
11.1 Platform content
All platform content such as text, graphics, logos and design is protected by copyright. The content is owned by Blinktank GmbH or used under licence.
11.2 Customer content
You grant us the right to use and publish your metadata on the platform. That covers contact, company and topic metadata. You warrant that you are authorised to grant these rights.
12. Final provisions
12.1 Changes to these terms
We may amend these terms with 4 weeks notice through a notice of the change. If you do not object within 4 weeks of receipt, the new terms apply. If you object, you and we may terminate the contract in the ordinary manner.
12.2 Severability
If a provision of these terms is invalid, the other provisions remain effective. We replace the invalid provision with a valid provision that comes closest to the economic purpose.
12.3 Applicable law
German law applies. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12.4 Place of jurisdiction
The exclusive place of jurisdiction is Berlin if you are a merchant. That also applies to a legal person under public law. That also applies to a special fund under public law.
12.5 Written form
Changes or additions to this contract must be in writing. That also applies to a change of this written-form clause. Emails satisfy the written form if an authorised person sends them.
