Asbestos remediation – Bavaria

1. Responsible authorities

Bavaria has seven administrative districts, each with a Gewerbeaufsichtsamt (GAA). The GAA at the company's registered office is responsible for approval. The GAA at the construction site is responsible for notification.

For notifications, responsibility lies specifically with Department G21, Construction Worker Protection and Asbestos Remediation at the relevant GAA. Online portal: BayernPortal.

2. Specialist contractor approval (high risk)

Required for demolition and remediation work involving weakly bound asbestos (friable).

Apply to the GAA at the company's registered office, Department G21. Applications can be submitted in writing, by email or online through BayernPortal.

Documents:

  • Proof of technical equipment in accordance with TRGS 519, Anlage 8
  • Proof of a competent person (valid certificate of competence)
  • Proof of the employer's reliability
  • Proof of employees' occupational medical examinations
  • Risk assessment

Fees: Approval is charged according to effort; no fixed standard fee is publicly stated.

3. A Notification requirement

All commercial activities involving asbestos are subject to notification.

Fees for notifications: The notification itself is free. Only deadline reductions cost at least 150 EUR plus expenses.

Online: Bavaria offers fully digital notification through BayernPortal.

The approval notice is subject to a fee.

4. Disposal

Small quantities (households / small businesses): Districts, independent cities or waste management associations accept small quantities at recycling centres or at Class I or II landfill sites.

Waste disposal companies may classify mineral construction and demolition waste of up to around 10 m³ as containing low levels of asbestos without analysis and accept it at suitable landfill sites. This rule comes from the FAQ published by LfU Bayern.

Larger quantities (specialist companies): Approved specialist waste disposal companies with a consignment note (AVV 17 06 01*). Class I landfill sites accept firmly bound asbestos. Class III landfill sites or special landfill sites accept weakly bound asbestos. Bavaria landfill list: LfU Bayern, Deponien.

5. Special features

  • Seven independent Gewerbeaufsichtsämter: each has its own contacts, with no central asbestos department for all of Bavaria.
  • Fully digital online notification: Bavaria offers all notifications online through the BayernPortal.
  • Shortening the deadline is subject to a fee: at least 150 EUR plus expenses, regulated transparently.
  • 10 m³ rule: Via LfU, Bavaria publishes a quantity threshold for simplified disposal of small quantities without laboratory analysis.
